A Freedom woman appeared in Outagamie County Circuit Court for allegedly hitting and killing a man after a night of drinking.

According to the criminal complaint, charges against 24-year-old Kendra Bruley were amended after the district attorney says Stephen Gebert died nine days after the August 11th crash.

"He's the 16th fatality due to a motor vehicle accident," said Sgt. Nathan Borman of the Outagamie County Sheriff's department.  "Of those, now some of the results are still pending, I can say 7 to 9 have been directly alcohol related."

The criminal complaint states Bruley now faces a charge of homicide by intoxicated use of a vehicle.  She waived her right to a preliminary hearing in court Wednesday.

"One vehicle had turned in front of a motorcycle and the motorcycle struck the other car,"  said Sgt. Borman. "That sent the motorcyclist over the car and into the roadway."

According to the criminal complaint, Bruley admitted to drinking three to four beers before her car and a motorcycle crashed at the intersection of State highway 15 and Hyacinth Lane around 9:30 p.m. on August 11th.

Court records indicate the responding deputy could smell alcohol on her breath and her eyes were red and glassy.

"Over the last week, plus a few days, his progress actually deteriorated,  so because of that then we filed the amended charges for the OWI homicide," said Outagamie County District Attorney Carrie Schneider.

In court Wednesday, the judge said there was enough evidence to move forward with the case.

Bruley's arraignment was set for August 29th.
