Not guilty plea for man charged in connection to fatal officer-involved shooting in Appleton

The man charged in connection to the fatal officer-involved shooting at Jack's Apple Pub in Appleton appeared in Outagamie County court Friday. 

The court entered a not guilty plea for Henry Nellum, 33, of Oshkosh after his attorney stated they would "stand mute" to all charges.

His lawyer also pushed for the court to dismiss the charge of attempted aggravated battery that Nellum faces.

Nellum is charged with felony murder for allegedly firing a gunshot at Jack's Apple Pub in May that police say led to a fatal officer-involved shooting.

Jimmie Montel Sanders, of Milwaukee, was killed when Appleton Police responded to the bar after Nellum allegedly got into a fight with another man and fired his gun, court documents said.

Sanders was described as an innocent bystander.

A trial date will be set September 26 at Nellum's status conference.
