The wife of Michael Funk, the man killed after being taken hostage at Eagle Nation Cycles has filed a lawsuit against the city of Neenah.
Michael Funk was taken hostage by Brian Flattoff December 5th, 2015. He was shot and killed after exiting the building with a gun. Police say he did not listen to instructions to drop the weapon he was holding.
The City of Neenah says it received notice of a claim from DeWitt, Ross & Stevens Thursday on behalf of Theresa Mason-Funk for over $3.5 million. City Attorney Jim Godlewski says the claim names the city and three Neenah Police Officers. Godlewski releasing this statement in response, "While the City is unable to comment in detail regarding any ongoing claim, a precursor to litigation, one of the claim's inaccuracies compels a correction. Officer Kuffel, a named party, did not respond to Michael Funk's actions when he exited the back of Eagle Nation Cycles on December 5th."
