State attorneys ask for stay in voter ID case

MADISON (AP) -- State attorneys have asked a federal judge to stay a ruling allowing people to vote without photo identification pending an appeal.

U.S. District Judge Lynn Adelman in Milwaukee issued a preliminary injunction this week allowing people who haven't been able to obtain IDs to vote in the Nov. 8 election if they sign an affidavit explain why they couldn't get the identification.

State Justice Department attorneys filed notice they would appeal the order with the 7th U.S. Circuit Court of Appeals on Friday. They also filed a motion with Adelman asking to stay the injunction while the appeal is pending, arguing they'll likely win the appeal. They said the affidavit option is unnecessary, overboard, expensive and burdensome.
