Green Bay man pleads "no contest" in vehicular homicide case

Convery facing up to 51 years behind bars

GREEN BAY, WI -- A Green Bay man has pleaded "no contest" to five charges stemming from a July 2015 car crash that killed one man and injured another.
 
Shortly after Monday afternoon's pleas, a judge found 52-year-old John Convery guilty on all counts: Homicide by Intoxicated Use of a Vehicle, Injury by Intoxicated Use of a Vehicle, Homicide by Negligent Operation of a Vehicle, Reckless Driving Causing Great Bodily Harm, and Possession of a Controlled Substance.
 
Convery and his attorney entered Alford pleas for the first two counts, meaning Convery asserts his innocence while admitting a a judge or jury would likely be persuaded of his guilt beyond reasonable doubt if it were to go to trial. 
 
All five counts are felonies. 
 
In a packed court Monday afternoon, the judge was adamant in making sure Convery understands what he's giving up with the "no contest" pleas, including a right to a jury trial.
 
According to the complaint, in July of last year, Convery had Valium in his system and Oxycodone in his truck when he lost control outside of Georgia Pacific and crashed into two people.
 
The crash killed Brian Delebreau, and seriously injured Paul Price, who were on break outside the plant. 
 
Sentencing in this case will take place on January 25th, at which point witnesses and family members will be able to testify.
 
Until then, however, Convery will remain outside of jail on bond.
 
 
 
According to the judge, Convery could face more than 51 years behind bars.
