A homicide charge has been filed against an 18-year-old, who allegedly shot and killed his friend in Waupaca County back in July.
Court documents filed in September, say the suspect, Austin Hovarter, told authorities he was playing cops and robbers with the victim when that shooting happened.
The victim, 15-year-old Jacob Peglow would later die.
The shooting was initially ruled an accident, but after reviewing the case, the prosecutor has now filed a homicide charge.
Court paperwork says the shooting happened in late July at a home on Reiben Road in Farmington.
In court documents, it says Hovarter and two friends were shooting guns. Hovarter explained that he had used the revolver four or five times playing cops and robbers. He told authorities he removed the handgun from the safe and pulled the revolver from the holster and while hanging onto the holster in his left hand, pulled the gun up in his right hand in what he described as a gangster display of the weapon, lifting it up to the right above his shoulder height to the right of his head, canting it slightly. He then stated he remembered pulling the trigger. Hovarter stated the gun then went off and at that time, he believed Jacob said, "I think you shot me.''
Austin Hovarter is set to appear in court on September 26th for a preliminary hearing.
He could face up to sixty years in prison if convicted.
