OCONTO COUNTY (NBC 26) -- Two Oconto County Sheriff's Office deputies who shot and killed a man will not face charges in the incident, according to a decision statement by Oconto County District Attorney Edward D. Burke Jr., which was released by the Wisconsin Department of Justice.

Oconto County Sheriff’s Deputy Kevin Christensen and Oconto County Sheriff’s Sergeant Ben Schindel shot Jacob Bubb at an Oconto County home back in May.

As previously reported, the Oconto County Sheriff’s Office responded to a home after receiving reports that Bubb, who had felony warrants, was there. The DOJ investigation revealed that Bubb had made statements back in March that he would never go back to jail.

Deputies searched the home and found Bubb in the basement, according to a summary from the district attorney, which said Bubb was holding a gun to his head and said, "I'll do it, I'll do it."

The report from the D.A. refers to a statement from the homeowner, who said he heard the deputies plead with Bubb to drop the weapon.

After Bubb refused to drop the gun, according to the investigation document, deputies used their tasers on Bubb, but the District Attorney's report said the tasers didn't appear to have an effect on him.

The investigation documents said Bubb then pointed his gun in the direction of the deputies, and Sgt. Schindel and Deputy Christensen fired their guns at Bubb.

An autopsy report later revealed Bubb died from multiple gunshot wounds. The district attorney's statement said Bubb's autopsy report noted "acute intoxication due to methamphetamine."

A notification from the Wisconsin DOJ said Thursday that the Oconto County District Attorney has determined that the use of deadly force was reasonable and no charges should be issued in Bubb's death.
