The Seventh Circuit Court of Appeals has denied Brendan Dassey's release, keeping him behind bars until a decision is made on the state's appeal of Dassey's overturned conviction.
The decision comes one day after Dassey's defense team said the state's request to keep him locked up was "not warranted." His lawyers argued the state is "highly unlikely" to successfully seek reversal of the court's decision to uphold Dassey's overturned conviction.
"He has been unconstitutionally incarcerated long enough," the response stated.
Now, the state will file a request for the full appeals court to reconsider the previous decision to uphold Dassey's overturned conviction.
If the court refuses to take the case or sides against the state again, there's a chance it will ask the Supreme Court to look at the case.
For now, Dassey will remain behind bars until the appeals process is complete.
Dassey was convicted a decade ago for the 2005 murder of Teresa Halbach along with his uncle, Steven Avery. In 2016, a federal judge overturned his conviction, ruling his confession was coerced.
Dassey and his uncle Steven Avery's case gained international fame after it was featured in the Netflix documentary "Making a Murderer."
