UPDATE: A verdict has been reached in Winnebago County Court. Brian Flatoff has been found guilty on all 14 counts.
-----------------------------------------
Brian Flatoff returned to Winnebago County Court for day four of a murder trial.
Flatoff is charged with felony murder after allegedly holding up Eagle Nation Cycle in Neenah in 2015.
A hostage, Michael Funk, was shot and killed mistakenly by police as he was trying to escape the building.
Police testified and said Funk was carrying a gun and they thought he was the shooter because he and Flatoff have a similar description.
On Thursday Flatoff came into court asking for an attorney after previously asking to represent himself.

Attorney Ben Szilagyi was appointed to take charge of the case. He asked for a new trial because he was not prepared to move forward.
The judge said the case will move forward and there's no legal reason for a mistrial.

The state argues "the entire City of Neenah" has waited over 2.5 years for a verdict, and a mistrial is against the WI constitution.
