Attorneys for Brendan Dassey have asked the Seventh Circuit Court of Appeals to deny the state's request for a rehearing by the full court.
In June, a three-judge panel ruled 2-1 that Dassey's confession to helping his uncle Steven Avery rape and murder Teresa Halbach was coerced by investigators.
The Wisconsin Department of Justicethen filed a petition in early July asking for the full Seventh Circuit Court of Appeals to hear arguments in the case against Brendan Dassey.
The state previously said that if the full court does not take the case or rules against the state, it would consider taking the case to the Supreme Court.
Dassey is serving a life sentence for Halbach's murder. The Seventh Circuit Court of Appeals denied Dassey's release recently, keeping him behind bars until a decision is made on the state's appeal of his overturned conviction.
Their story gained international attention when it was featured in the Netflix documentary "Making a Murderer."
A federal judge overturned his conviction last year, ruling investigators coerced Dassey into confessing. That decision was upheld by the Seventh Circuit Court of Appeals.
