17-year-old Devon Robley in Court Wednesday in Fatal OWI

A teenage boy accused of causing a crash that killed two people appeared before a judge Wednesday.

Devon Robley of Greenleaf is charged with two counts of homicide by intoxicated use of a vehicle and two counts of causing injury.

The court heard testimony from one of the deputies who responded to the crash. The deputy testified that results of Robley’s drug test showed he was positive for 1.0 nanograms of THC, the active ingredient in marijuana.

Robley's attorney argued that this amount should be considered negligible. He compared the amount to Colorado, where marijuana is legal, where the threshold for driving while intoxicated is 5.0 nanograms of THC. He also argued whether or not Robley admitted to being “high” as previously stated, questioning whether or not there was dash cam video of the incident.

However the judge believe that the State's burden of proof was met and Robley's next step would be an arraignment.

Robley's attorney also asked that he be able to go to therapy and get counseling in addition to being able to go to school and work in agreement with being free on bail.

He will be back in court October 4th at 11am.
