MANITOWOC (NBC 26) — Damian Hauschultz, the man convicted for his role in the death of 7-year-old Ethan Hauschultz, is set to be resentenced in April.
Hauschultz appeared virtually on Tuesday in front of a Sheboygan County judge for a status conference.
During the hearing, the court announced that both parties had reached a stipulation: the defense agreed to withdraw its post-conviction motion in exchange for a resentencing hearing.
Hauschultz was previously convicted and sentenced to 20 years in prison for the 2018 death of his foster brother, 7-year-old Ethan Hauschultz. However, he has been seeking a new trial or resentencing, claiming the judge in his case has a conflict of interest.
Damian is also a critical witness in the case against Timothy Hauschultz, his father. Timothy's trial has been delayed several times following rejected plea deals. It was most recently delayed after Damian refused to testify until the post-conviction motion was decided.
Prosecutors allege Timothy ordered Damian to punish Ethan with hard labor and punishment that ultimately led to the child's death.
Damian is scheduled to be resentenced on Apr. 24.
The next hearing for Timothy's case is a scheduling conference on March 18.
