Police hold off on charges involved in fatal bus accident

The Kaukauna Police Department will wait for a toxicology report before deciding on whether to refer charges against the bus driver who hit and killed 12 year old Justin Johnson. 

The 12-year-old River View Middle School student was walking home from school when he was hit crossing the intersection of Crooks Avenue and Second Street on September 6. Investigators say Johnson had pushed the crossing signal and had the right of way to cross the street at the time of the accident.
 
Police say the 61 year old driver has been with the Kobessen Bus for 3 years and has 30 years of driving experience. He is currently on administrative leave.
 
The company issued the following statement:
 
"The accident that took place on 09/06/16 was a tragic accident, our hearts go out to the family of the student. In the 78-year history of Kobussen bus we have not had a tragic accident like this one. We have received a great deal of public and school district support for our bus drivers. We will continue working with school bus drivers, the city and the school district to maximize safety. We work every day at safety and hope that an incident like this never happens again."

Officers say the driver is devastated by what happened and is fully cooperating with investigators.
 
After the accident, several witnesses and passerby's stopped to help Justin until emergency crews arrived at the scene. 
 
Since the tragedy, a make-shift memorial has appeared near the intersection.
