No criminal charges for school bus driver in fatal crash

Kaukauna Police say that the Outagamie County DA's office has decided that criminal charges will not be filed against the bus driver who hit and killed 12 year old Justin Johnson. 

The 12-year-old River View Middle School student was walking home from school when he was hit crossing the intersection of Crooks Avenue and Second Street on September 6. 

Lt. Jamie Graff says that the bus driver had his blood drawn for a drug and alcohol test on September 6 and it was sent to the Wisconsin State Laboratory of Hygiene. 

The results came back negative. 

The Outagamie County District Attorney's Office decided that they will not criminally charge the driver. 

The driver will be issued a citation for Failure to Yield right of way to a pedestrian, which comes with a $98.00 fine. 

Investigators say Johnson had pushed the crossing signal and had the right of way to cross the street at the time of the accident.
