Verizon sues Appleton over cell tower denial

APPLETON, Wis. (AP) -- Verizon Wireless is suing the City of Appleton because its Common Council rejected the company's plans for a cell tower.
 
A civil complaint filed by Verizon says the council's decision is in direct conflict with Wisconsin law. The council voted last month to deny Verizon's permit for a tower on the city's north side, despite a warning from the city attorney not to reject it.
 
USA Today Network-Wisconsin says the city has until Sept. 15 to respond to the lawsuit. State law restricts how and when local municipalities can deny cell towers and don't account for height or aesthetics. Exceptions are made for public health or safety.
 
The complaint asks the court to reverse the city's decision and pay Verizon attorney fees.
