A three-page letter delivered to Neenah City Hall Tuesday morning says the three men who submitted the complaint states they believe they will not receive a fair hearing at this time.

A citizen complaint filed by the owner of Eagle Nation Cycles alleges Neenah Police Chief Kevin Wilkinson  failed to act quickly enough to give Michael Funk medical attention during the standoff with Brian Flatoff.

In a meeting this morning, the Neenah Police Commission reviewed the complaint, deciding to accept it. The Commission says they will have legal council at their next meeting to review it.

Funk's supporters say he was an innocent man, taken hostage by Flatoff, and that the responsibility for his death falls squarely on Chief Wilkinson.

"We're upset that we have a lot of questions that no one will answer.  We've asked the Mayor questions that won't be answered, we've asked the Department of Justice, no one will sit down with us and just give us answers to the questions," said Eagle Nation Cycles owner, Steven Erato.

The complaint comes after Neenah Police were found justified in the shooting of Michael Funk by the State Department of Justice.

The Neenah Police Chief, Kevin Wilkinson says although he's a little nervous he trusts the system.

"There's a system in place to make sure that officials are held accountable and I think you saw evidence of that today that I think they're going to take it seriously they'[re going to do it right and the truth prevails," said Chief Wilkinson.

The Neenah Police Commission will meet on Sept. 7 to review the complaint.
