Judge orders HIV test for suspect in Oshkosh assault

UPDATE: 10/10/2016-- Timothy Cole has pleaded not guilty, due to not being competent at the time. A medical examiner has 30 days to file reports. Cole has a pre-trial scheduled for November 22nd.

UPDATE 9:29 AM 9/29/16-- Timothy Cole, the man facing attempted 1st Degree Homicide and assault charges was ordered to undergo testing for HIV. Cole, in court Thursday morning, waived his preliminary hearing. His next court appearance is scheduled for October 10.


UPDATE 12:12 P.M. -- Oshkosh police are recommending charges of attempted 1st degree homicide, 1st degree sexual assault, false imprisonment and substantial battery in connection with the assault of a woman early Wednesday morning. The Winnebago District Attorney will review the case against the suspect.


UPDATE 7:31 a.m. -- Oshkosh Police are praising a woman for her quick thinking during a Wednesday morning assault.

Lt. Kevin Konrad tells NBC26 that neighbors heard a woman screaming around 3:30 a.m. Wednesday.

Officers forced their way into the home in the 1600 block of S. Oregon Street.  Police found a woman who said she had been severely attacked by a man she met earlier in the night.

The woman had broke out the window in an attempt to escape. 

Police were able to find the man in the area. He was arrested and charges are expected to be filed Wednesday.

The woman who was attacked was taken to an area hospital and should make a full recovery.

Lt. Konrad says this was a severe attack and a traumatic situation. They say the woman did a lot of things right and kept her cool.

Officers remain at the scene, processing information.

More details are expected to be released by Oshkosh Police later today. 


UPDATE 6:15 a.m.-- Oshkosh Police have taken a man into custody.

We're still waiting to learn more information from police.
