The teen charged in a Brown County fatal crash was in court Wednesday.

Devon Robley faces charges of homicide by intoxicated use of a vehicle after a fatal crash in July. Authorities say he had marijuana in his system at the time of the accident.

In court, a Sheriff's Deputy that responded to the crash testified to what he saw. When asked why there wasn't video from his squad car the deputy said it was a possible memory card error.

Robley's attorney says the amount of marijuana in his system at the time of the crash was negligible and could not be the cause of the accident.

The Brown County District Attorney's Office has filed charges of homicide by intoxicated use of a vehicle against 17-year-old Devon Robley of Greenleaf. Deputies say Robley was smoking marijuana shortly before running a stop sign and slamming into an SUV at the intersection of County Road X and Glenmore Road near Denmark on July 11.

Two people died as a result of the crash. Robley's next court appearance is scheduled for August 31.
