The Freedom From Religion Foundation plans to file a lawsuit against Manitowoc County for the religious display that sits on the lawn in front of the courthouse. "We are a country ruled by law and this is lawless," said Annie Laurie Gaylor, the co-president of the Madison based group.

According to the foundation, the lawsuit will most likely be filed on Tuesday or Wednesday. Rod and Cheryl Kjelstrup wrote an editorial urging the county to take the display down and have been receiving some flack from community members about their choice to be vocal. "I pay taxes too and it's not representing me, and I'm sure there are many other people out there in the same situation too," said Rod Kjelstrup. The couple wants to make clear they are not against Christmas or Nativity displays, but they think they should just not be erected on government property.

"This has been a tradition here in Manitowoc County for the past 50 some years, we have never had a problem until recently when Green Bay had problems with their nativity scene," said Jim Brey, Manitowoc County Board chairperson. He believes the county's display is lawful. He says he hasn't received the official lawsuit papers, but plans to fight it, and win. "They are trying to stir-up trouble," said Brey. The County Executive said in a written statement, "We believe our policy is fair, legal and easy to follow. We will be happy to defend ourselves vigorously if called upon."
